IMPORTANT: The “Dispute Resolution” section below mandates that any claims you have against Abest Green Power must be resolved through arbitration, meaning you cannot bring such claims to court, and includes a waiver of class action rights during arbitration. This affects your legal rights, so please read it thoroughly.

This website is operated by Abest Green Power (“Abest Green Power,” “we,” or “us”). These terms and conditions of use (“Site Terms”) govern your access to and use of the www.abestgreenpower.com website, along with any other Abest Green Power websites that link to these terms (collectively, the “Sites”). These Site Terms do not alter the terms or conditions of any other agreements you may have with Abest Green Power for products or services (“Customer Agreement”). If there is any conflict between these Site Terms and any Customer Agreement you have with Abest Green Power, the terms of the Customer Agreement will take precedence.

We retain the right to modify or change any part of these Site Terms, or any related policies or guidelines on the Sites, at any time and at our sole discretion. Any updates or modifications will become effective immediately upon being posted to the Sites, and you waive any right to receive notice of such changes. Your continued use of the Sites following the posting of any modifications constitutes your acceptance of the updated terms. It is your responsibility to review these Site Terms and applicable policies periodically to stay informed of any updates. If you do not agree with the amended terms, you must discontinue your use of the Sites.

2. Mobile Communications

If you request updates or other information via your mobile phone or text message, you consent to us communicating with you through your mobile device.

While we do not charge for messaging services, your carrier’s usual messaging, data, and other fees may apply. Check with your carrier for applicable charges and plan details. Carriers are not liable for delayed or undelivered messages.

3. Copyright and Limited License

Unless otherwise indicated, the content on the Sites, including but not limited to the Abest Green Power logo, designs, text, graphics, images, data, software, tools, widgets, audio files, and other materials (collectively referred to as “Site Materials”) are the proprietary property of Abest Green Power, its licensors, or its users and are protected by U.S. and international copyright laws.

You are granted a limited, non-sublicensable license to access and use the Sites and Site Materials solely for informational, non-commercial, and personal purposes. This license is subject to these Site Terms and does not permit: (a) the resale or commercial use of the Sites or Site Materials; (b) the reproduction, distribution, public performance, or public display of any Site Materials, unless explicitly permitted on the Sites; (c) modification or creation of derivative works from the Sites or Site Materials; (d) the use of data mining tools, robots, or similar data extraction methods; (e) downloading (other than page caching) any portion of the Sites or Site Materials unless explicitly permitted; or (f) any use of the Sites or Site Materials that does not align with its intended purpose.

Any use of the Sites or Site Materials beyond what is authorized here, without prior written consent from Abest Green Power, is prohibited and will terminate the license granted. Unauthorized use may also violate applicable laws, including but not limited to copyright and trademark laws and relevant communication regulations. Unless specifically stated, these Site Terms do not confer any rights to intellectual property, whether by estoppel, implication, or otherwise. This license may be revoked at any time.

4. Repeat Infringer Policy

In accordance with the Digital Millennium Copyright Act (DMCA) and other relevant laws, Abest Green Power has adopted a policy to terminate, at its sole discretion and under appropriate circumstances, the accounts of subscribers or users who are identified as repeat infringers. Additionally, Abest Green Power reserves the right, at its sole discretion, to limit access to the Sites or terminate the accounts of users who infringe upon the intellectual property rights of others, regardless of whether the infringement is repeated.

5. Copyright Complaints

If you believe that material on the Sites violates any copyright that you own or control, you may file a notice of such infringement with our Designated Agent at the address listed below. Please provide a complete and valid notice following the requirements set forth by law.

The trademarks, logos, and slogans displayed on the Sites are the property of Abest Green Power, its suppliers or licensors, or other third parties. These materials may not be copied, imitated, or used in part or whole without the prior written permission of Abest Green Power or the respective trademark owner. Except as outlined above, you are not granted any rights or licenses, either by implication, estoppel, or otherwise, under any patents, trademarks, copyrights, or proprietary rights of Abest Green Power or third parties.

Abest Green Power does not claim responsibility for, nor does it make any representation regarding, the quality, content, or reliability of third-party websites linked to or from the Sites. These external sites are not under the control of Abest Green Power, and we are not responsible for the content of any linked site or any changes or updates to such sites. Abest Green Power provides these links purely as a convenience, and their inclusion does not imply any affiliation, endorsement, or adoption of the site or its contents.

You agree that Abest Green Power is not responsible or liable for any Third-Party Content and has no obligation to update or review it. You use such content at your own risk.

9. Submissions

You acknowledge that any feedback, suggestions, comments, ideas, or other materials regarding the Sites or Abest Green Power that you provide, whether via email or other means of submission, are non-confidential and become the property of Abest Green Power. Abest Green Power retains exclusive rights, including all intellectual property rights, and is entitled to the unrestricted use and distribution of such submissions for any purpose without acknowledgment or compensation to you.

10. User Content and Interactive Areas

The Sites may include services or areas (“Interactive Areas”) where users can create, post, share, or store content such as messages, materials, data, information, text, graphics, audio, video, or other materials (“User Content”). You are solely responsible for the use of such Interactive Areas and do so at your own risk.

By using these Interactive Areas, you agree not to post, upload, transmit, or distribute any User Content that:

(a) is unlawful, defamatory, obscene, harassing, threatening, or otherwise objectionable;
(b) promotes criminal activity, violates any laws, or encourages illegal actions;
(c) infringes upon any patent, trademark, copyright, or other intellectual property rights;
(d) impersonates any person or entity or misrepresents your affiliation with any person or entity;
(e) contains unsolicited promotions, advertising, or political campaigns;
(f) includes private information about any third party, such as addresses, phone numbers, or credit card information;
(g) contains viruses, malware, or other harmful files;
(h) violates any rules or guidelines posted by Abest Green Power;
(i) is deemed objectionable by Abest Green Power or limits another’s ability to use or enjoy the Sites.

Abest Green Power assumes no responsibility or liability for any User Content posted by you or any third party and is not liable for any mistakes, defamation, or unlawful content you may encounter. Your use of these Interactive Areas is at your own risk.

While Abest Green Power reserves the right, at its sole discretion, to remove, screen, or edit any User Content posted on the Sites, it has no obligation to do so. You are responsible for creating backup copies of your User Content and ensuring its safekeeping.

By posting User Content to the Sites, unless otherwise indicated, you grant Abest Green Power and its affiliates a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content worldwide in any media or format, without compensation or attribution to you. You also grant Abest Green Power and its sublicensees the right to use any name you submit in connection with such content. 11. Registration Data and Account Security

As a condition of your use of the Sites, you agree to: (a) provide accurate, up-to-date, and complete information about yourself as required by any registration forms on the Sites (“Registration Data”); (b) ensure the confidentiality of your password and identification; (c) maintain and promptly update your Registration Data and any other information you provide to Abest Green Power to keep it accurate and current; and (d) accept responsibility for any unauthorized access to your Registration Data or other information you provide to Abest Green Power.

12. Indemnification

You agree to defend, indemnify, and hold harmless Abest Green Power, its contractors, service providers, consultants, and their respective directors, employees, and agents from and against any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from or related to any User Content you post or transmit via the Sites, your use of Interactive Areas, or any actions relating to your use of the Site or User Content. This includes, but is not limited to, any claims or legal actions brought against Abest Green Power, its contractors, employees, or agents that are caused by or relate to your User Content, conduct, violation of these Site Terms, or infringement of any third-party rights.

Unless otherwise stated in writing by Abest Green Power, the Sites, their contents, and the services provided on them are offered “as is” without warranties of any kind, either express or implied. Abest Green Power disclaims all other warranties, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, as well as any warranties related to the accuracy or reliability of information on the Sites.

Abest Green Power does not guarantee that the Sites, Site Materials, or services are error-free, complete, or current. We are not responsible for typographical errors, omissions, or inaccuracies related to pricing, text, or imagery. While we aim to ensure your access to the Sites is secure, we cannot guarantee that the Sites or servers are free from viruses or harmful components, and we recommend that you use industry-standard antivirus software to protect your devices.

Abest Green Power is not liable for third-party activities or events listed on the Sites, nor for any actions of event organizers or other users. We reserve the right to modify any content on the Sites, including services offered, at any time without notice. Reference to any third-party products, services, or information does not imply endorsement or affiliation with Abest Green Power.

Our Sites utilize various Google Maps APIs, and by using the Sites, you agree to be bound by Google’s Terms of Service.

14. Limitation of Liability

Under no circumstances will Abest Green Power or its employees, agents, or volunteers be held liable for any direct, indirect, incidental, special, or consequential damages of any kind, including, but not limited to, loss of use, profits, or data, whether in contract, tort, or otherwise, arising from or related to your use of the Sites, services, or Site Materials. This includes any reliance on information obtained from Abest Green Power, or any damages resulting from mistakes, omissions, delays, or failures of performance due to factors like viruses, system failures, or unauthorized access.

In no event will the total liability of Abest Green Power exceed the amount you have paid, if any, for access to or use of the Sites. Certain states do not permit limitations on implied warranties or exclusion of certain damages, so the above disclaimers or limitations may not apply to you.

15. Applicable Law and Dispute Resolution

Please read this section carefully, as it impacts your legal rights. These Site Terms and your use of the Sites are governed by and interpreted in accordance with the laws of the State of Delaware, without reference to conflict of law provisions. You and Abest Green Power agree to resolve any disputes or claims through binding arbitration according to the rules of the American Arbitration Association (AAA). Additionally, you agree that arbitration will be conducted on an individual basis only, and class action claims are prohibited, even if AAA rules might allow them.

16. Termination

Abest Green Power reserves the right, in its sole discretion and without prior notice, to terminate your license to use the Sites and block your access to the Sites if you violate these Site Terms or for any other reason.

17. Severability

If any provision of these Site Terms is deemed unlawful, void, or unenforceable, that provision will be severed from these terms and will not affect the validity or enforceability of the remaining provisions.
